Delta Govt Clarifies VAPP Law, Warns Against Abuse in Indecent Dressing Enforcement

The Delta State Government has issued a strong clarification on the implementation of the Violence Against Persons Prohibition (VAPP) Law 2020, cautioning security agencies to exercise restraint, professionalism, and respect for human rights in its enforcement.

The caution was delivered on Thursday in a statement by the State Commissioner for Justice and Attorney General, Mr. Ekemejero Ohwovoriole, amid rising concerns over plans by security agencies to begin statewide enforcement of the law particularly around the issue of “indecent dressing.”

Ohwovoriole emphasized that while the VAPP Law criminalizes certain acts under “indecent exposure” of private parts, it does not authorize law enforcement officers to harass or punish individuals based on appearance or fashion choices.

“It is essential to emphasize that the interpretation and application of the Law rests exclusively with a Court of law. No security operative has the power to impose any punishment on any individual without due process of law,” the Commissioner stated.

He further warned that the use of the term “indecent dressing” by some agencies, in place of the law’s precise language “indecent exposure” was problematic and opens the door for potential human rights violations.

The Attorney General made it clear that no provision in the VAPP Law gives blanket powers to arrest or penalize citizens arbitrarily based on subjective views of decency.

"Any such action must follow proper legal procedures and be founded on lawful complaints or charges brought before a competent court of law,” he noted.

He urged residents of the state to report any abuse or rights violations to the Office of the Public Defender in the Ministry of Justice, assuring that the state remains committed to upholding constitutional rights and the rule of law.
