Sodomy: Court Sentences One to Life Imprisonment in Sokoto

The Court of Appeal sitting in Sokoto has on Monday sentenced Sani Ibrahim to life Imprisonment for having a canal knowledge of two Qur'anic School Pupils in Sokoto metropolis.

The presiding judge Justice Ibiowei Tobi  during the court proceedings said, based on the general principle of law, evidences and  testimonies of PW1 and the PW2 and PW3 who were victims of the offence, the court was satisfied beyond reasonable doubt that the offence was committed.

According to him PW2 has confessed to the Court that Sani Ibrahim has unzip him while sleeping in room at their Qur'anic School and had Anal intercourse with twice, and PW3 also in his confession before the lower court revealed that the Appellant had on three occasion had Anal intercourse with him while sleeping at the same vicinity with the other victim, the PW2.

Justice Tobi however in his judgment set aside the earlier of the lower court which discredit all evidences and testimonies granted by PW1, PW2 and PW3 and passed judgment in favour of the accused.

The lower court at its judgment dismissed the evidence from PW1 which the judge says was a heresy while evidences from PW2 and PW3 was not attached or substantiated by a sworn court affidavit.

"The lower court owe to convict the accuse in the first instance as evidences from PW1, PW2 and PW3 are enough to corroborate one another and sentence the offender, " The accuse his confessional statement admitted that he used to have canal intercourse but not with the victims, PW2 and PW3 as alleged." Says justice Tobi.

"Gone are the days when defence  counsel will confuse people, How could accuse confessed to committing a crime before a Court of law and later set free?" Asked justice Tobi.

"The convict Sani Ibrahim is an Animal who doesn't deserve to be in the midst of  human beings" Said justice Tobi.

He said, "based on all evidences and confessional statements available before the court, The court is convinced beyond reasonable doubt that, the accuse has committed the offence and therefore sentence him to life imprisonment."
