Delta court grants ex parte motion, adjourns hearing to December 8

The Delta State High Court, Orerokpe Judicial Division, sitting in Orerokpe, Okpe Local Government Area, has granted an ex parte motion in a matter concerning the estate of the late Mr. Akpuhi Godwin Oghenekaro in Suit No. HOR/L/77/2025. The court also adjourned the substantive hearing to December 8, 2025.

The motion was brought before the court by Mrs. Elohor Avwaruroro Okoye, with Julius Ezegwu, on behalf of the complainant/applicant, Mr. Awoziakpo Akpuhi. The Probate Registrar of the Delta State High Court, Mrs. Akpuhi Stella Omotejowho sued for herself and as guardian ad litem of Christabel Ajiroghene Akpuhi and Maiki Ohenevwehba Akpuhi is listed among the defendants.

Other defendants in the suit include Miss Akpuhi Oghaleoghene Splendour, WellBerg Energy Service Nigeria Limited, NNPC Exploration and Production Limited, Chevron Nigeria Limited, and First City Monument Bank Plc.

In the ex parte application, counsel to the applicant sought several interim orders. These include “an order of interim injunction restraining the 2nd and 3rd defendants by themselves and/or through their agents/subordinates/officials from operating, withdrawing or in any way making any transaction in respect of the personal and corporate accounts of Late Mr. Akpuhi Godwin Oghenekaro pending the hearing and determination of the motion on notice.”

Another request sought “an order of interim injunction restraining the 2nd and 3rd defendants from selling, collecting rents, alienating and/or further selling, leasing or interfering with the landed properties of Late Mr. Akpuhi Godwin Oghenekaro, pending the hearing and determination of the motion on notice.”

The applicant further prayed for “an order of interim injunction restraining the 4th and 7th defendants from releasing funds or permitting the 2nd and 3rd defendants to deal with the properties of the 4th defendant and the estate of Late Mr. Akpuhi Godwin Oghenekaro.”

Similarly, the motion sought to restrain the 5th and 6th defendants from making any payments to the 2nd, 3rd, and 4th defendants arising from any contractual obligations involving the 4th defendant, pending determination of the motion.

The applicant also sought “an order staying the execution and/or further enforcement of the letter of administration (without will) issued by this Honourable Court on February 17, 2025, appointing the 2nd and 3rd defendants as the only administrators of the personal estate of Late Mr. Akpuhi Godwin Oghenekaro.”

After hearing from counsel for the applicant, presiding judge Hon. Justice Joe Egwu ruled in favour of the application. “The motion ex parte dated and filed 28/11/2025 is hereby ordered as prayed,” the court held.

Justice Egwu subsequently adjourned the matter to December 8, 2025, for the hearing of the motion on notice.
